Decision-Making Process for the Texas Assessment Program (Grades 3-12) Section 39.027 (e) of the Texas Education Code requires the Texas Education Agency (TEA) to develop an assessment system that evaluates the academic progress, including reading proficiency in English, of limited English proficient (LEP) students. In addition, Section 39.023 (m) of the Texas Education Code requires TEA to develop procedures for language proficiency assessment committees (LPACs) to follow to ensure that exempted LEP students are administered the Texas Assessment of Knowledge and Skills™ (TAKS™) at the earliest practical date.
