How will the Texas Education Agency (TEA) addressthe training requirements of the Texas Administrative Code (TAC)§ 89.1053 (Procedures for Use of Restraint and Time-Out)?
TEA has designated to Region IV Education Service Center (ESC) the leadership role for developing the training content, materials and initial ESC training to address the time-out and restraint requirements in the TAC §89.1053.Interested parties may view two letters that explain the implementation of the legislative mandate in more detail at:

What is the training content?
Legislative mandates require training on a full continuum of positive behavioral intervention strategies and professionally accepted practices and standards for behavior management.The TBSI training will provide tools to assist districts/campuses in complying with the documentation and notification requirements for the use of restraint and time-out. The initial TBSI training will consist of approximately 12 hours of instruction excluding the physical restraint component.

What is the format of the training?
The training is organized in six (6) modules to allow for flexibility at the district/campus level.The modules could be presented in a two-day training session or across time (i.e., faculty meetings, after school, etc.). The module content is as follows:

  • Module 1: Legislative Overview
  • Module 2: Positive Behavioral Supports: Schoolwide/Classroom Interventions
  • Module 3: Positive Behavioral Supports: Individual Interventions
  • Module 4: Time-Out
  • Module 5: Severe Behavior:Prevention and De-Escalation Techniques
  • Module 6: Action Planning (ESC/District training teams)
  • Module 7: Physical Restraint (district selects provider)

Is the training for Physical Restraint included in the TBSI training?
No, Module 5: Severe Behavior:Prevention and De-Escalation Techniques will provide a list of critical attributes for training on physical restraint procedures.Districts/campuses will use the critical attributes to select physical restraint training programs.Module 5 will also address the notification/documentation requirements for restraint.

How does a district/campus access the TBSI training?
In June 2002 a team of trainers from each ESC will participate in training on the TBSI modules.ESCs will receive resources and materials necessary to implement the TBSI training at the regional level.Each ESC will determine the most appropriate method of regional implementation.Options might include:

  • training district-level teams who would then train individual campuses
  • training campuses, or
  • utilizing a combination of both options.

Who are the required campus-level trainees? When do they have to be trained?
Each campus will need to train a core team 1 including:

  • campus administrator or designee;
  • general or special education personnel likely to use restraint; and
  • general or special education personnel who implement time-out based on requirements established in a student’s IEP.
By April 1 2003, training should be complete for campus-level teams. After April 1, 2003, personnel who meet the one of the following criteria must be trained within 30 school days:
  • Time-out 2—new or additional personnel called upon to implement time-out based on requirements established in a student’s IEP
  • Restraint 3--personnel called upon to use restraint in an emergency and who have not received prior training

Are the requirements of TAC §89.1053 applicable to Juvenile Justice Alternative Education Programs (JJAEP)?
Yes, the Texas Education Code (TEC) §37.0021 and the Commissioner Rules regarding the use of time-out and restraint (TAC §89.1053) apply to JJAEPs but not to secure correctional and detention facilities that are not served by school districts.Therefore, school personnel providing educational services to students in JJAEPs are subject to the provisions of TEC §37.0021.
